In order for Secured Servers to be considered to be 'on notice' of a violation, we must ask that you, as stipulated by the Digital Millennium Copyright Act, provide us with the specific image names and/or URLs of the images or material against which the infringement claim is being made, as well as ALL of the following:
(1) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is being infringed;
(2) Identification of the copyrighted work claimed to have been infringed;
(3) Identification of the material that is allegedly infringing;
(4) the complaining party's address, telephone number and email address;
(5) a statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
(6) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
With this information, Secured Servers can take swift and serious action against any network user which may be in violation of copyright law. However, as you know, Secured Servers exposes itself to potential liabilities for unfair termination of service if this information is not provided; and we cannot legally be considered to be ”on notice” until then.
